Course Contents
Data can be valuable in various ways. Protection and confidentiality interests collide. The law responds to this by granting protection to certain data. On the other hand, it recognises that there are legitimate interests in accessing and using data. The lecture with integrated exercises covers both aspects. It first introduces data protection law and deals with the General Data Protection Regulation (GDPR), which aims to protect personal data on the one hand, but also to enable the free movement of such data on the other. It also addresses the special features of contract law that arise from data protection in relation to contracts that deal with personal data or consider personal data a from of payment. The course then turns to the EU Data Act, which seeks to facilitate and promote the exchange and use of data within the European Economic Area. Finally, it introduces the Data Governance Act, which is intended to create the basis for a European data exchange model.
